1. Agreement to These Terms
Welcome to nhsportshouse.com. These Terms of Service ("Terms") are a legal agreement between you and NH SportsHouse LLC, doing business as NH SportsHouse ("NH SportsHouse," "we," "us," or "our"), a sports training and athletic facility located in Manchester, New Hampshire.
These Terms govern your use of our website, our online booking and registration systems, our memberships, and your access to and use of our facility, programs, leagues, camps, clinics, rentals, and training services (together, the "Services").
By visiting the website, creating an account, booking a rental, registering for a program, purchasing a membership, or entering our facility, you agree to these Terms. If you do not agree, please do not use the Services.
If you are registering a child or another person, you are agreeing to these Terms on their behalf and on your own behalf.
2. Who May Use the Services
You must be at least 18 years old to create an account, make a purchase, book facility time, or register a participant.
Participants under 18 may take part in our programs only when a parent or legal guardian completes registration, provides emergency contact information, and accepts these Terms on the participant's behalf. Youth participants are subject to any supervision, drop off, and pickup policies posted at the facility.
You agree that the information you provide during registration is accurate and complete, and that you will keep it current.
3. Accounts and Account Security
Some Services require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us right away at admin@nhsportshouse.com if you believe your account has been used without your permission.
We may suspend or close any account that we believe has been used in violation of these Terms, our facility rules, or applicable law.
4. Bookings, Registrations, and Facility Rentals
Reservations. Cage rentals, turf rentals, court time, private lessons, and similar bookings are confirmed only after payment is received and you receive a confirmation from us. Reservations are for the specific date, time block, and space listed in your confirmation.
Programs and registrations. Camps, clinics, leagues, teams, and training programs may have limited capacity, age requirements, skill requirements, minimum enrollment numbers, and registration deadlines. We reserve the right to cancel, combine, reschedule, or adjust any program that does not meet minimum enrollment or that is affected by circumstances outside our control.
Schedule changes. Facility schedules, staffing, coaching assignments, field or court availability, and program dates may change. We will make reasonable efforts to communicate changes in advance through email, text message, or a notice posted on nhsportshouse.com.
Capacity and time limits. You agree to vacate your reserved space promptly at the end of your time block and to bring only the number of participants and guests permitted for that space.
5. Memberships and Recurring Billing
If you purchase a membership, you authorize us to charge your payment method on a recurring basis at the interval and rate shown at checkout until you cancel.
Memberships renew automatically unless cancelled before the next billing date. Membership benefits, hours of access, and rates may change with advance notice. Memberships are personal to the member, are not transferable, and may not be shared.
To cancel a membership, contact us at admin@nhsportshouse.com or use the cancellation option in your account. Cancellation stops future charges. It does not refund charges already processed.
6. Pricing, Payments, and Fees
All prices are listed in United States dollars and are subject to change. You authorize us to charge the payment method you provide for the full amount of your purchase, including any applicable taxes and fees.
Online payments and registrations are processed through Stripe and Upper Hand. We do not store full payment card numbers on our systems. Your use of those platforms is also governed by their own terms and privacy policies.
If a payment fails, is reversed, or is charged back, we may suspend your bookings, membership, or program access until the balance is resolved, and we may charge a reasonable administrative fee.
7. Cancellations, Rescheduling, and Missed Sessions
All payments to NH SportsHouse are final and nonrefundable unless a refund is expressly stated in writing for a specific program, package, or membership at the time of purchase. This applies to rentals, private lessons, camps, clinics, leagues, program registrations, deposits, and membership fees.
Rescheduling. We may allow you to reschedule a rental or private lesson if you give us at least 24 hours notice and we have comparable availability. Rescheduling is a courtesy we offer when we can, not a guarantee, and it is not available inside 24 hours.
Missed sessions. Sessions you miss, arrive late for, or cancel inside 24 hours are charged in full and are not made up.
Memberships. Cancelling a membership stops future billing. It does not refund charges already processed, and unused member benefits do not carry over.
Cancellations by us. If we cancel a session, program, or rental outright and cannot offer a reasonable replacement date, we will issue a facility credit for the cancelled portion.
Closures. Because our programming is indoors, closures are rare. If severe weather, a facility issue, a utility outage, or another event outside our control forces a closure, we will offer a makeup date or a facility credit when possible.

8. Assumption of Risk and Release
Please read this section carefully.
Athletic training, conditioning, instruction, and competitive play involve inherent risks, including the risk of serious injury, permanent disability, and death. These risks come from the nature of the activity itself, from equipment, from playing surfaces, from the actions of other participants, and from your own physical condition.
By participating, you knowingly and voluntarily assume all risks connected with your participation and with the participation of any minor you register.
To the fullest extent permitted by New Hampshire law, you release and hold harmless NH SportsHouse, its owners, officers, employees, coaches, instructors, volunteers, contractors, and landlords from any claim, demand, or cause of action arising out of your participation or your presence at the facility, except for claims arising from our gross negligence or willful misconduct.
You confirm that each participant is in adequate physical condition to take part and has been cleared by a physician if there is any question about fitness to participate. NH SportsHouse does not provide medical care, athletic training services, or medical clearance. You authorize us to seek emergency medical treatment for a participant if we reasonably believe it is needed, at your expense.
9. Facility Rules and Code of Conduct
Everyone at NH SportsHouse, including athletes, parents, spectators, coaches, and guests, agrees to:
Follow all posted facility rules and the directions of our staff.
Treat staff, athletes, officials, and other families with respect.
Use equipment only as intended and only in the areas designated for it.
Refrain from abusive language, harassment, threats, fighting, and any conduct that endangers others.
Keep alcohol, tobacco products, vaping devices, illegal drugs, and weapons off the property.
Supervise their own children in common areas, lobbies, and parking areas.
We may remove any person from the facility, cancel a booking, or end a membership for conduct that violates these rules, without refund.
10. Personal Property
NH SportsHouse is not responsible for lost, stolen, or damaged personal property, including bats, gloves, bags, phones, and items left in lockers, cubbies, or vehicles. Please label your gear and take valuables with you.
11. Photography, Video, and Media Release
We photograph and record activity at our facility for promotional, instructional, and social media purposes.
By entering the facility or participating in our programs, you grant NH SportsHouse a nonexclusive, royalty free, perpetual right to use photographs, video, and audio that include you or your registered participant in our marketing materials, website, social media accounts, and other promotional content, without further approval or compensation.
If you do not want your participant included in our media, send a written request to admin@nhsportshouse.com before participation begins, and we will make reasonable efforts to honor it. We cannot control photography or recording by other families, opposing teams, or third parties on our premises.
12. Communications and Text Messages
By providing your email address or mobile number, you agree to receive messages from us about your bookings, registrations, schedule changes, closures, and account. You may also receive marketing messages about programs, camps, clinics, and events.
You can opt out of marketing emails using the unsubscribe link in any message, and out of marketing text messages by replying STOP. Message and data rates may apply. We may still send you transactional messages about a booking or account even after you opt out of marketing.
13. User Content
If you post reviews, photos, comments, or other content to our website or tag us on social media, you keep ownership of your content and grant us a nonexclusive, royalty free, worldwide license to display, reproduce, and share that content in connection with promoting NH SportsHouse.
You agree not to submit content that is unlawful, defamatory, harassing, obscene, or that infringes the rights of another person, and you confirm you have the right to share anything you post. We may remove any content at our discretion.
14. Intellectual Property
The NH SportsHouse name, logo, marks, program names, website design, text, graphics, photography, video, training curricula, and other content on nhsportshouse.com are owned by NH SportsHouse or its licensors and are protected by copyright, trademark, and other laws.
We grant you a limited, revocable, nonexclusive license to view and use the website for your personal, noncommercial purposes. You may not copy, reproduce, republish, scrape, sell, or create derivative works from our content without our prior written permission.
15. Prohibited Uses
You agree not to:
Use the Services for any unlawful purpose or in violation of these Terms.
Attempt to gain unauthorized access to our website, accounts, servers, or booking systems.
Introduce viruses, malware, or other harmful code.
Use bots, scrapers, or automated tools to access the site or reserve facility time.
Resell, sublet, or transfer reserved facility time without our written approval.
Impersonate another person or misrepresent your affiliation with any person or organization.
Use our facility to run competing instruction, training, or commercial activity without a written agreement with us.
16. Third Party Links and Services
Our website may link to or rely on third party services, including payment processors, registration platforms, scheduling software, mapping tools, and social media platforms. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Your use of them is at your own risk.
17. Privacy
We collect the information you give us when you create an account, register a participant, book facility time, or contact us. That includes names, contact information, emergency contact details, and participant information such as age, grade, and sport. We use it to run your bookings and programs, to communicate with you about your account, and to improve our Services. We do not sell your personal information.
Payment and registration data is handled by Stripe and Upper Hand under their own privacy policies. We do not store full payment card numbers on our systems.

18. Disclaimer of Warranties
The website and the Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, NH SportsHouse disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
We do not warrant that the website will be uninterrupted, secure, or error free, that scheduling information will always be accurate, or that participation in our programs will produce any particular athletic result, scholarship outcome, recruiting outcome, or level of improvement.
19. Limitation of Liability
To the fullest extent permitted by New Hampshire law, NH SportsHouse and its owners, employees, coaches, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to your use of the Services.
Our total liability for any claim arising out of or related to the Services will not exceed the amount you paid to NH SportsHouse in the six months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
20. Indemnification
You agree to indemnify and hold harmless NH SportsHouse and its owners, employees, coaches, contractors, and affiliates from any claim, loss, liability, damage, cost, or expense, including reasonable attorney fees, arising out of your use of the Services, your violation of these Terms, your violation of any law, or the conduct of any participant or guest you register or bring to the facility.
21. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict of laws rules.
Before filing any formal claim, you agree to contact us at admin@nhsportshouse.com and work with us in good faith for at least 30 days to resolve the dispute informally.
If the dispute is not resolved, you agree that it will be brought exclusively in the state or federal courts located in Hillsborough County, New Hampshire, and you consent to the jurisdiction of those courts. Each party gives up any right to bring or participate in a class action against the other.
22. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on nhsportshouse.com with a new "Last Updated" date. Material changes will be communicated by email or a notice on the site. Continued use of the Services after an update means you accept the revised Terms.
23. Termination
We may suspend or terminate your access to the website, your account, your membership, or your facility access at any time, with or without notice, for conduct that violates these Terms or that we believe is harmful to other users, our staff, or our business. Sections that by their nature should survive termination, including assumption of risk, release, limitation of liability, indemnification, and governing law, will survive.
24. General Terms
Entire agreement. These Terms, together with any membership agreement, rental agreement, or program specific policy, make up the entire agreement between you and NH SportsHouse.
Severability. If any provision is found unenforceable, the rest of these Terms remain in effect.
Enforcement. Our failure to enforce any provision does not give up our right to enforce it later.
Assignment. You may not assign your rights under these Terms. We may assign ours in connection with a sale, merger, or transfer of the business.
Force majeure. We are not liable for failure to perform caused by events outside our reasonable control, including severe weather, fire, flood, utility failure, labor disruption, public health orders, or government action.
